Elbasan Prosecution Office declares its lack of subject matter jurisdiction concerning the case of " the structured criminal group" responsible for several serious incidents - the case file is submitted to SPAK
Prosecution Office at Elbasan Court of First Instance of General Jurisdiction, acting upon the investigative material supplied by the Local Police Directorate of Elbasan, has registered criminal proceedings no. 1599 of 2021. This case pertained to the criminal offenses as provided for in articles 78 of 25, and 278 of the Criminal Code.
Following the investigation into this case, substantial doubts have arisen regarding the individuals under investigation that they are the perpetrators of the citizen A.S’s murder, an incident that has occurred in Peqin, on 17.10.2021.
Furthermore, as a result of the investigations employing specialized methods, there exists a suspicion that these citizens, in complicity with others, are the authors of some grave criminal incidents (including murder, explosive property destruction, violent theft, facilitating of conditions and means for homicides, etc.) that have occurred in the time period 2021-2023 in varioius cities throughout the country such as Elbasan, Tirana, Lushnje, Tepelën, Korçë and Durrës. These incidents have been subject to official proceedings registered by the relevant prosecutions of the general jurisdiction, which then have passed for subject matter jurisdiction to Elbasan Prosecution office and have been consolidated into a single proceeding under No. 1559 of 2021, for the criminal offenses as provided for in articles 78 and 25, 78/a and 25, 78 and 22, 25; 152, 25; 80, 25; 139, 25 and 278 of the Criminal Code.
In the current case, assessing that there have been committed elements of the criminal offense as provided for in article 333/a of the Criminal Code "The structured criminal group" and as provided for in article 334 of the Criminal Code “Commission of criminal offences by criminal organizations and structured criminal groups", we have considered to re-evaluate the issue of subject matter jurisdiction regarding this criminal proceeding.
On 18.10.2023, it was decided the declaration of lack of subject matter jurisdiction concerning the investigations for criminal proceedings no.1559 of 2021 registered in the Prosecution office at Elbasan Court of First Instance, and
Submitting the acts for further investigations to the competent prosecution, notably the Special Prosecution at the Court of First Instance Against Corruption and Organized Crime (SPAK) in Tirana.
