Tirana Prosecution Office demands E.M.'s arrest for falsification and environmental damage; He handled hospital waste without the proper equipment, and using false documents; Measures for public inspectors as well

Tirana Prosecution Office, within criminal proceeding No. 1255 of 2024, has sought the security measure of “Remand in Custody” for E.M. on charges of document falsification.

The prosecution, in collaboration with the Economic Crime Counter-Sector at Tirana LPD has conducted thorough investigations, including interrogations, inspections, and seizures at various institutions. These efforts have led to the conclusion that the case involves elements of criminal offenses outlined in articles 186/3, 201/a, 201/c, and 248 of the Criminal Code.

Evidence reveals that the individual under investigation, E.M., has been involved in over 200 tender procedures for hospital waste disposal since 2016, submitting falsified documentation. Despite claiming to possess the necessary capabilities for waste collection and treatment, investigations have shown a lack of equipment to accomplish such a thing.
Furthermore, it has come to light that E.M., in complicity with E.Sh. has been counterfeiting documents since 2015. These falsified documents were used in requests submitted to the NAE, through NRC, and in the periodic self-monitoring reports, falsely describing compliance with Type B Permit regulations. Notably, an Econos Tsc 150 device, supposedly installed in January 2024, was cited in these documents.

The legal entity was inspected by state employees I.B and K.A, who chose to disregard the absence of the Econos Tsc 150 device. Likewise, state inspectors J.Sh, E.P, A.M, N.D, A.K, B.L, also failed to accurately report the operational activities of the legal entity. They omitted documenting the discharge points into the air and land from the Mangazini equipment, previously identified by Engineer G.T in the historical records. Additionally, they neglected to mention that instead of the intended activity, only an incinerator had been installed.

Evidence confirms that the Econos TSC 150 device, examined by judicial police officers, was imported on January 22, 2024, by the legal entity different from what  E.M under investigation declared that the Econos TSC 150 device was imported and installed in 2016."

These findings raise suspicions regarding the legal entity's ability to fulfill contractual obligations related to hospital waste treatment, given the absence of the Econos Tsc 150 device and that of the one incinerators.

The investigations persist in scrutinizing the actions and inactions of public entities, alongside potential collaborators and accounting practices, concerning the potential environmental consequences accumulated over years.
