Update on the criminal offenses in the field of elections
Tirana, November 2, 2021. Consequent to the administrative and procedural measures taken by the General Prosecutor to guarantee the normal functioning of the prosecution in compliance with constitutional and legal obligations for the period before, during and post-election, the prosecution is committed to the investigation of criminal offenses regarding elections as the subject- matter competence of general jurisdiction.
Based on the reports of the prosecution offices of general jurisdiction on criminal offenses regarding elections for the pre-election period, it results that the prosecution offices have registered criminal proceedings for 82 denunciations of criminal offenses related to the elections out of which 2 are registered ex officio.
There are currently 10 (ten) persons who are being prosecuted for the above criminal offenses. Four persons were arrested in flagrante delicto, while for 3 (three) persons was requested the security measure "prison arrest" and the request was accepted for 2(two) persons.
Prosecutions of general jurisdiction have received a total of 158 denunciations of criminal offenses regarding elections, out of which 91(ninety one) directly to the prosecution. Of the latter, there are 70 (seventy) denunciations from political entities / candidates directly to the prosecution, 3(three) denunciations from citizens to the prosecution and 18 (eighteen) denunciations from state institutions to the prosecution.
Out of the registered cases, 20 cases with 2 persons under investigation have ended with a dismissal decision. There have been suspended 3 (three) cases and there are 4 (four) cases with 4 (four) persons on trial.
There are 13 (thirteen) denunciations for criminal offenses regarding elections in the process of preliminary verification to the prosecutions of the general jurisdiction, while there were transferred 24 denunciations to SPAK for subject- matter competence, and it is decided not to initiate criminal proceedings for 34 denunciations.
