Vlora Prosecutor's Office completed investigations into the incident in Himara where the minor J.A. lost her life. The charges against the 9 defendants

The Prosecutor's Office at the Court of First Instance of Vlora, has completed the investigations for the criminal proceedings no. 918/2022, the acts of which refer to the criminal offense of "Deliberate murder" and "Abuse of duty" provided for by article 76 and 248 of the Criminal Code.

The criminal fact refers to the event dated 02.08.2022, which happened in the area of Potam, Himare, where the minor J.A. died, as a result of the collision by the watercraft MERCURI, NENA 154, which was driven by the citizen A.T.

The investigation showed that the incident occurred as a result of the failure of the driver of the watercraft, citizen A.T., to respect the designated (restricted) area for swimmers, as well as the wrong maneuver in driving the vehicle. 

The investigations are focused on the responsible institutions charged with the implementation of security on the beaches during the tourist season, specifically the Himarë Municipality, the Himarë Police Station as well as the Local Border and Migration Directorate of Vlorë, taking as defendants the following citizens:

A.T, for the criminal offense of "Deliberate murder" indirectly provided by Article 76 of the Criminal Code;

F.M., acting as the head of the border sector in the Vlore Local Border and Migration Directorate, accused of the criminal offense of "Abuse of duty" provided for by Article 248 of the Criminal Code;
N.B., acting as the station chief at the Border Police Station, Dhërmi, in the border sector of the Local Directorate for Borders and Migration, Vlore, accused of the criminal offense of "Abuse of duty" provided for by Article 248 of the Criminal Code;
L.A., B.M. and K.H., acting as the service troops in the watercraft BP06, in charge of controlling the coastline at the Dhërmi Border Police Station, Vlore, charged with the criminal offense of "Abuse of duty" provided for by Article 248 of the Criminal Code; 
A.D. acting as an order specialist at the Himar Police Station, accused of the criminal offense of "Abuse of duty" provided for by Article 248 of the Criminal Code; and
B.A. and A.B., acting as the responsible officers and employees of the Municipal Police in Himarë, accused of the criminal offense of "Abuse of duty" provided for by Article 248 of the Criminal Code as employees who performed periodic checks at the scene of the incident.
